GAME RULES

Amaury’s Goggles

 

1.     Organising Company and presentation of the Game

 

1.1. WBD Sports Events Limited, Discovery House Chiswick Park Building 2, 566 Chiswick High Road, London, England, W4 5YB, with company number 04361881 (the « Organising Company »), organises from Monday 11th November to Friday 15th November at 23:59 UTC+02:00) included a game, in the form of sweepstake, titled « Amaury’s Goggles » (the « Game »).

 

1.2. The Game is organised in partnership with Oakley (the « Partner »).

 

1.3. The Game takes place on the Internet website/ the social media accessible at the following URL address: https://www.instagram.com/uci_mtbworldseries/ (the « Platform »).

 

2.     Participation and acceptance of the Rules

 

2.1. Participation in the Game implies that each participant (hereinafter, the "Participant(s)") has read and accepted, without reservation, these rules (the "Rules"), which apply to all Participants, and the principle of the Game. Any Participant who contravenes one or more of the articles of these Rules will be deprived of the opportunity to take part in the Game, as well as of any Prize, as defined in article 6 hereinafter, that he or she may have won.

 

2.2. The Game is open to all natural persons over the age of eighteen (18), residing in European Union.

 

2.3. Under no circumstances may persons who have collaborated in the organisation of this Game or who have a direct or indirect legal link with the Organising Company and/or the Partner take part in this Game.

 

2.4. Any form of participation in the Game other than that expressly defined in these Rules is excluded and will not be taken into consideration by the Organising Company.

 

If it appears that a Participant uses equipment or an application to circumvent the Rules, by masking his/her identity through the manipulation of IP addresses, or by using any other identity or any other automated means in order to increase the number of his/her entries, he/she will be disqualified.

 

Incomplete entries and entries made by automated means will also be disqualified.

 

2.5. Participation in the Game is limited to one entry per person (same e-mail address and same full name). Group entries, in particular by commercial establishments, consumer groups or others, will not be accepted.

 

A Participant registered with several e-mail addresses will be disqualified. Any attempt at fraud on the part of a Participant will result in the invalidation of all entries submitted. Any falsified, fraudulent, false, misleading, incorrect or inaccurate indication of identity or e-mail address will result in disqualification of the Participant's participation in the Game.

 

2.7       All entries received after Friday 15th November at 23:59 UTC+02:00) will be considered null and void.

 

3.     Access to the Rules

 

3.1. Each Participant may consult the Rules free of charge:

4.     Game mechanism and rules

 

4.1. To take part in the Game and have a chance of winning the Prize, each Participant must @oakleybike & @uci_mtbworldseries, like and comment the post and accept these present Rules without reservation (the « Entry »).

 

4.2. Participants accept that any answers they may have given to the questions asked to make the Game more interactive, if applicable, will have no effect on their chances of winning, as the draw is based solely on chance and in no way takes into consideration Participants' answers to the questions.

 

 

5.     Determining the Winner(s)

 

5.1. A random Draw (the « Draw ») will be done by the Organising Company at the end of the Game among all the Participants who have entered in accordance with the terms of these Rules.

 

5.2. The Draw will take place on Monday 18th November 2024.

 

5.3. At the end of the Draw, two (2) winners (the “Winners” and each a “Winner”) and six (6) substitutes (the « Substitutes ») will be designated.

 

5.4. No message will be sent by the Organising Company to the Participants who have not won the Game.

 

5.5. The Winner shall be informed of his/her victory by the Organising Company within a maximum of two (2) days following the Draw. The Organising Company will contact the Winner to confirm his/her Prize and organise its delivery, at the e-mail address or telephone number provided through the Entry, or when the Game is organised on social media, via private message. No message will be sent to the Participants who have not won.

 

5.6. In the event that the Winner does not confirm his/her prize within fifteen (15) days of being contacted by the Organising Company, or if the Winner declines his/her prize, or if the Winner has not fulfilled the conditions of Participation or has not complied with these Rules, the Organising Company shall designate as Winner the first Substitute according to the order established during the Draw, proceeding under the same conditions as for the first Winner chosen, and so on, until the actual delivery of the Prize.

 

5.7. The Prize will be declared null and void and will not be awarded to any Participant if it is not possible, in the final instance, to award the prize to any of the Substitutes designated in the Draw.

 

6.     Prize(s) and terms of award

 

6.1. Each Winner will receive the following prize: one Airbrake MTB Goggles of a value of 130€ (the « Prize »).

 

Other Participants may not claim any prize or compensation.

 

6.2. The Organising Company/ the Partner reserve the right to replace the Prize with a prize of equivalent value, without the Participants and the Winner being able to make any claim in this respect.

 

6.3. In certain cases, the Winner may be asked by the Organising Company to sign a form accepting the Prize (the « Acceptance Form ») within a period of fifteen (15) days after the Organising Company has notified them that they have won, failing which the Prize may not be awarded to the Winner.

 

6.4. The Participants are entirely responsible for the validity of their contact details given at the time of their Entry and the Participants acknowledge that the Organising Company may not be held responsible for the non-delivery of e-mails and/or the Prize due to incomplete, imprecise or incorrect contact details.

 

6.5. Upon request from the Organising Company, the Winner undertakes to provide a copy of his/her identity document to the Organising Company in order to confirm his/her identity. Without this, the Organising Company will not be able to award the Prize.

 

6.6.  Once the Participant's information has been validated, the Prize will be awarded to the Participant by the most appropriate means within three (3) months of the completion of the validation process, by the Organising Company or the Partner.

 

6.7. Everything that is not expressly included in the Prize as referred to above is deemed to be excluded (by way of example: personal expenses or any other expense that the Winner may incur in connection with his/her participation in the Game, the enjoyment/use of the Prize).

 

6.8. In the event that the Prize involves travel, no matter if the cost is born by the Organising Company, the Partner or the Winner and whatever the means of transport and whatever the destination, the Winner is solely responsible for taking the necessary steps and obtaining the necessary documents, enabling them, where applicable, to travel to the destination (by way of example, passports, visas, authorisations, insurance).

 

6.9. The Prize may not be exchanged or taken back, nor may it be the subject of any financial consideration or financial equivalent. Any complaints regarding the provision of the Prize may not consist of financial consideration and/or a financial equivalent. The Prize is personal and non-transferable and under no circumstances may a person other than the Winner be designated as the winner or beneficiary.

 

6.10.                Il It is specified that the Organising Company will not provide any guarantee, assistance, enjoyment or provision service, as the Prize consists solely in the provision/implementation of the Prize as described in the present Rules.

 

6.11.                Under no circumstances will the Organising Company be held responsible for the delay in making the Prize available or in the event that the Winner is unable to benefit from the Prize due to circumstances beyond the control of the Organising Company.

 

7.     Authorisations

 

7.1. The Winner expressly accepts, free of charge, that his/her surname, first name, entered on the Platform may be quoted and published by the Organising Company and/or the Partner.

 

7.2. In this regard, the Winner grants, in advance and without financial consideration, the Organising Company and the Partner a non-exclusive licence to use, reproduce, represent and communicate his/her first name, surname for promotional purposes for the Game or the activity of the Organising Company or the Partner, on all communication media. This option does not constitute an obligation for the Organising Company and/or the Partner.

 

7.3. This licence is granted for the entire world, for all uses on all media and by all distribution processes known or unknown to date, and for the entire duration of the legal protection of intellectual property (including renewals and extensions).

 

7.4. The Organising Company and the Partner may not be held liable in the event of false or inaccurate statements made by the Participant, or in the event of infringement of the rights of third parties committed by the Participants in the context of the Game, and the Participants release the Organising Company and the Partner from any liability in this regard.

 

8.     Personal Data

 

8.1. Participation in the Game may involve the collection and processing, by the Organising Company, of certain personal data of the Participants and the Winner.

 

In accordance with the law of June 20, 2018 on the protection of personal data, Participants in the Game have a right to access, rectify and object to information concerning them and collected in the context of the Game, by writing to the Organising Company at the address specified in Article 1 of these Rules or at the following address: wbdprivacy@wbd.com.

9.     Liability and reserves

 

9.1. The Organising Company and the Partner may not be held liable for any total or partial malfunctioning of the Internet network, whether or not this results in failures in the administration, security, entry, integrity or management of the Game. In particular, they may not be held liable for any errors, omissions, imperfections, interruptions, deletions, transmission delays, communication and connection circuit failures, destruction, damage or any other problem related to telecommunications networks, computers and online terminals, servers or access providers.

 

9.2. The Organising Company reserves the right to exclude from participation in this Game any person who disrupts its progress. It reserves the right to take legal action against anyone who has cheated, defrauded, rigged or disrupted the operations described in these Rules or attempted to do so. Any Winner who has cheated will be automatically stripped of any right to obtain any Prize.

 

9.3. The Organising Company reserves the right, in particular in the event of an overriding reason, to shorten, extend or cancel the Game in part or in its entirety if circumstances so require, and the Participants acknowledge that it may not be held liable as a result.

 

9.4. The Organising Company reserves the right to temporarily suspend the possibility of participating in the Game if it or any of its technical service providers (and in particular its hosting service providers) are no longer able to ensure the continuity of the service necessary for the Game to run.

 

9.5. The Organising Company may always, in the event of force majeure, a fortuitous event or an exceptional circumstance (fire, flood, natural disaster, malicious intrusion into the computer system, strike, questioning of the financial and technical equilibrium of the Game, etc.), even if this is its own responsibility (subject in any case to its good faith), cease all or part of the Game.

 

9.6. The Game will be cancelled in the event of the dissolution of the Organising Company or the Partner, as well as in the event of force majeure, without Participants being entitled to claim any compensation in this respect.

 

9.7. Any information provided by the Participants, in particular their contact details, will be considered null and void and will not be taken into consideration if it contains an anomaly.

 

9.8. The Participants acknowledge that the Organising Company may not be held liable for any prejudice of any kind (personal, material, financial or other) arising from their participation in the Game.

 

9.9. The Organising Company shall in no way be held liable towards the Winner in the event of the occurrence of any event beyond the company's control making it impossible to enjoy/use the Prize.

 

9.10. The Organising Company expressly declines all liability for any incident or prejudice of any nature that may arise as a result of the Participants' participation in the Game and/or enjoyment of the Prize and/or as a result of its use by the Winner, and this is expressly acknowledged by the Participants and the Winner. The Participants and the Winner therefore waive any claim and any recourse against the Organising Company and/or the Partner and/or any of the companies in the group to which they belong (namely, for the Organising Company, the Warner Bros. Discovery Inc. group), on the aforementioned grounds, and in particular, as regards the Prize, its quality or any consequences arising from taking possession of the Prize.

 

10.  Applicable Law and Dispute Resolution

 

10.1.                In order to be taken into account, any disputes relating to the Game must be made no later than thirty (30) days from the end of the Game, in writing only and sent to the following address:

10.2.                The Organising Company shall decide any question relating to the application of these Rules or not settled by these Rules. With the exception of cases of fraud by the Participants, any dispute that may arise in connection with the execution of these Rules shall be settled as a matter of priority out of court between the Organising Company and the Participant.

 

10.3.                The Game is governed by the laws of the Participants’ country of residence. By participating, Participants consent and submit to the exclusive jurisdiction of the courts of their country of residence for any action however so arising out of these Rules.
